Crime no-208/26, PS- Itaunja (Lucknow) Remand Appose

Certified Court Order Document

Legal Brief & Court Pronouncement

In Crime No. 208/2026 under Sections 191(2), 190, 115(2), 352, 351(3), 61(2), 333, and 308(5) of the BNS, P.S. Wazirganj produced the accused, Mohd. Salman, before the Remand Magistrate, Lucknow, seeking a 14-day judicial remand. Defense counsels Deepak Singh and Sam Shiraz presented strong documentary evidence alongside the complainant (Mohd. Mohsin), who personally appeared and filed an affidavit revealing that the police had replaced the final page of his original typed complaint to falsely implicate Salman—his business partner and cousin—while submitting proof of continuous threatening calls and pressure from SHO Rajesh Kumar Tripathi. The high-stakes hearing, which extended until around 11:30 PM, also saw the court severely reprimanding SHO Wazirganj for using his mobile phone during proceedings, leading to the confiscation of his device, contempt of court action, and issuance of a show-cause notice. Finding no corroborative evidence or CCTV footage against Salman, the court rejected the remand application, ordered Salman's release on a ₹10,000 personal bond, and referred the matter along with the complaint-tampering allegations to the Police Commissioner, Lucknow, for departmental inquiry and necessary action.
