Itaunja, the Court of Sessions Judge, Lucknow, observed that the alleged offenses carry a punishment of 7 years or less, affording the applicant statutory protection from arrest under Section 35(3) of the BNSS and the Supreme Court’s guidelines in Arnesh Kumar vs. State of Bihar. Consequently, finding no immediate apprehension of arrest, the court rejected the anticipatory bail plea on 21.07.2026, while directing the Investigating Officer to strictly comply with the Arnesh Kumar judgment, issue a notice under Section 35(3) BNSS within two weeks if not already served, and instructed the applicant to cooperate with the ongoing investigation.
